EU-LOGOS Athena – Dossier «ASILE et IMMIGRATION : Etat des lieux»

La création de l'Agence européenne pour la gestion de la coopération opérationnelle aux frontières extérieures des États membres de l'Union européenne répond à l'exigence d'améliorer la gestion intégrée des frontières extérieures des États membres de l'Union européenne.

Même si les États membres sont responsables du contrôle et de la surveillance des frontières extérieures, l'Agence facilite l'application des mesures communautaires, existantes et futures, relatives à la gestion de ces frontières.

On entend par frontières extérieures des États membres les frontières terrestres et maritimes de ces derniers ainsi que leurs aéroports et ports maritimes, auxquels s'appliquent les dispositions du droit communautaire relatives au franchissement des frontières extérieures par les personnes.

Sans préjudice des compétences de l'Agence, les États membres peuvent poursuivre la coopération établie au niveau opérationnel avec d'autres États membres et/ou pays tiers aux frontières extérieures, lorsque cette coopération complète l'action de l'Agence. Les États membres informent l'Agence des activités menées dans le cadre de cette coopération en dehors de l'Agence.

-    The European Agency for the Management of Operational Cooperation at the External Borders of the Member States of the European Union was established by Council Regulation (EC) 2007/2004/ (26.10.2004, OJ L 349/25.11.2004).

-    This Regulation was later amended by the Regulation (EC) No 863/2007 of the European Parliament and of the Council of 11 July 2007 establishing a mechanism for the creation of Rapid Border Intervention Teams and amending Council Regulation (EC) No 2007/2004 as regards that mechanism and regulating the tasks and powers of guest officers.
